В статье рассматриваются актуальные вопросы правового регулирования иници ативного бюджетирования как одной из форм участия населения в осуществлении местного самоу правления. На основе анализа Федерального закона от 20 марта 2025 г. № 33-ФЗ «Об общих принципах организации местного самоуправления в единой системе публичной власти» и сложившейся практики субъектов РФвыявляются ключевые проблемы фрагментарности нормативной базы, недостаточной гарантированности прав граждан и низкой вовлечённости населения в бюджетный процесс. Особое внимание уделено коллизиям, возникающим при соотношении муниципального уровня и уровня субъ екта РФ, а также дефициту единых стандартов конкурсного отбора инициативных проектов. В работе предложены направления совершенствования законодательства, включая установление минималь ныхфедеральных гарантий, развитие цифровых инструментов и расширение финансовой самосто ятельности муниципалитетов в рамках инициативного бюджетирования. Исследование опирается на официальные статистические данные Министерства финансов РФ, нормативно-правовые акты и результаты опроса Всероссийского центра изучения общественного мнения.

The article examines current issues of legal regulation of participatory budgeting (initiative budgeting) as a form of public participation in local self-government. Based on the analysis of Federal Law No. 33-FZ of March 20, 2025 «On the General Principles of Organizing Local Self-Government in the Unified System of Public Authority» and the established practices of the constituent entities of the Russian Federation, the study identifies keyproblems, including the fragmentation of the regulatory framework, insufficient guarantees of citizens’ rights, and lowpublic engagement in the budget process. Special attention is paid to conflicts arising from the interaction between the municipal and regional levels, aswell as the lack of uniform standards for the competitive selection of initiative projects. The paper proposes directions for improving legislation, including the establishment of minimum federal guarantees, the development of digital tools, and the expansion of financial independence of municipalities within the framework of participatory budgeting. The research is based on official statistical data from the Ministry of Finance of the Russian Federation, regulatory legal acts, and the results of a survey conducted by the Russian Public Opinion Research Center.
